Nike shares jump 6.2% on results







Sportswear giant Nike shares closed with a sharp gain on Friday after it reported a strong rise in demand in its home North American market.






Shares rose 6.2% after the company’s third quarter figures suggested steady demand for its products around the world.


Orders for delivery of its shoes and clothing for the coming months were up 14% in the home market.


Worldwide orders for the December-April period were up 6%,


Nike’s chief executive, Mark Parker, said the level of home demand was a welcome boost: “In North America, we created great momentum. This is somewhat counterintuitive to some, given this market size and assumed maturity.


“But I see tremendous growth potential in North America.”


The company’s past reported orders were lower than expected.


Profit margins were down by 30 basis points on the second quarter, but Nike said it expects margins to grow in the fourth quarter.


The company made profits of $ 384m in the third quarter, 14% higher than analysts were expecting with revenue up 7%.


Despite the positive figure, Nike’s global performance was weak in certain areas, such as China, where it had excess stock and faces strong competition from local brands.


However, the picture there is improving with inventory levels rising 9% in the quarter, a far smaller build-up of excess stock than the 35% it saw in the same quarter a year ago.

Showrooming little threat to clothiers in ho-hum holidays






Chicago (Reuters) – In retail, showrooming has not hit shirts yet.


Showrooming, the retail term for shoppers who try a product, then buy it cheaper on Amazon.com or other websites, has driven retailers to the point of hiding barcodes, improving their own websites and coming up with methods to get people to complete their purchase in the store.






But brand-name clothing retailers have an advantage over companies that sell items you can buy anywhere, like televisions and home goods.


Specialty apparel retailers are some of the least affected by showrooming since the more exclusive the product is, the harder it is to showroom,” said Joel Bines, managing director of the retail practice at advisory firm AlixPartners.


That, in turn, has helped retailers like Gap Inc and Lululemon Athletica Inc find favor with investors.


A survey of 2,010 adults conducted by AlixPartners showed consumers who shop for apparel were among the least likely (35 percent) to go to other websites after they liked an item at a store, compared with 42 percent of electronics shoppers and 41 percent of those looking for accessories like watches and jewelry.


“If you look at some of the most successful (clothes) companies in the past few years, they are those that have that moat around them,” said hedge fund manager Shawn Kravetz, who runs Esplanade Capital in Boston.


He cites yogawear maker Lululemon and Gap as good examples of how it can help to have clothes that are not sold elsewhere.


If a shopper wants to buy a Banana Republic or Nordstrom shirt from the latest season, they have to buy it either from their stores or online shop.


Discount retailers like Zappos, Amazon and others stock brand-name products, but the merchandise is often not from the current season or limited in colors and sizes.


“I don’t need to see if a television fits my body shape when I buy a TV,” said Joe Megibow, senior vice president of omni-channel e-commerce at American Eagle Outfitters. The teen clothes retailer has seen better sales than its peers over the past year.


“I can get a sense of the TV and I’m good. Clothing is different. Does it fit me, is it my style, do I like the quality of the material and how it is put together. There’s so much more with apparel that matters,” he said.


That is the part of the reason, analysts say, why online-only clothing companies like Bonobos and Gap’s Piperlime have started opening brick-and-mortar stores or tied up with retailers to sell their products in physical locations.


Choice and easy availability are the two most important aspects of shopping, especially during a holiday season that has lost steam after what looked like strong Thanksgiving sales.


Estelle Tran, an “impulsive” shopper in her twenties, agreed.


“If I want to buy books, tech items, DVDs, I would definitely buy online. For clothes, I would rather (visit stores) as it is also a fun experience to try on clothes,” said the Chicago-based finance auditor.


Tran said she would definitely check prices online if she was spending more than $ 100.


Luxury and high-priced items can be more susceptible to showrooming, because pricing is what drives the behavior, said Marshal Cohen, chief economist at the consultancy NPD Group.


“With electronics and certain consumer goods it is very easy to compare specific brands across multiple websites. But (showrooming is) happening and it will be growing. If a (clothes) retailer isn’t taking it seriously, they are going to fall behind,” said Bolette Andersen, principal in KPMG’s retail industry practice.


ROOM TO GROW


Some investors are betting on apparel stocks because of their relative insulation from the threat of showrooming.


While the S&P Apparel Index has returned a sizzling 27.71 percent year to date, according to Reuters data, far outperforming the S&P 500, which is up 14.80 percent, more gains may be coming.


“We still think there’s plenty of room to grow,” said Brian Peery, co-portfolio manager at Hennessy Funds. Its growth fund, heavily weighted in apparel and consumer discretionary goods shares, is up 30 percent over the year.


“As we look into the sector 12-18 months, we continue to buy the discretionary area. Two of our heaviest investments would be Foot Locker Inc and TJX Companies Inc,” he said.


Discount chains like TJX and Ross Stores, which sell branded clothes at low prices, have benefited from the surge in bargain-seeking shoppers.


Even the stocks of retailers like Gap and American Eagle that have staged or are staging turnarounds have gotten a good boost over the year. Gap has soared 69 percent and American Eagle is up 31 percent.


R. Shawn Neville, president of Avery Dennison retail branding and information solutions, said another reason that apparel and to a broader extent other consumer discretionary stocks do well is because of their sustainability.


“In uncertain times, investors look towards market segments that have strong underlying demand which are more stable, like the apparel industry,” Neville said.


Moreover, in times of economic uncertainty, shoppers can still afford clothes and shoes, as opposed to a new car, home, or expensive vacations, helping apparel stocks do well, he said.


“Though Amazon is clearly stealing some share in various categories, clothes retailers, say Abercrombie & Fitch isn’t going anywhere. They’re not being run out of the shopping mall,” said Esplanade’s Kravetz.

Rebel Wilson to host springtime MTV Movie Awards






LOS ANGELES (AP) — “Pitch Perfect” star and “Bridesmaids” scene-stealer Rebel Wilson is taking center stage.


MTV tapped the Australian actress to host its annual movie awards, set for April 14 in Culver City, Calif. The network made the announcement late Thursday during the finale of its popular “Jersey Shore” series.






Wilson is an actress and writer who rose to fame with her role as Kristin Wiig‘s nosy roommate in “Bridesmaids.” Wilson’s other credits include “Bachelorette” and “What to Expect When You’re Expecting.”


The MTV Movie Awards have traditionally been held in June, but as the summer movie season has edged into May, the network scheduled its show earlier to give film fans a peek at the season’s blockbusters. The MTV Movie Awards has often featured exclusive film previews.

Windows already threatening iPhone in Southern Europe






Kantar Worldpanel’s report for November came out and much has been made of the iPhone market share surge in the United States. What I find interesting in the November numbers is just how ice cold the iPhone has gone in so many international markets, from Australia to Brazil to Southern Europe. The iOS market share showed hefty declines outside in many major markets: down 5.4 percentage points in Australia to 35.9% and down 1.6 points in Brazil to 1.6%. That’s right — the iPhone market share has halved in the most important South American market over the past year. And this happened while BlackBerry and Symbian market shares absolutely caved in. This should have been the period for Apple (AAPL) to pick up points while RIM (RIMM) and Nokia (NOK) floundered. Instead, the sky-high pricing of the iPhone models has effectively started reversing Apple’s market share gains across several major markets.

In November, the burden of the stiff iPhone pricing was highlighted by how rapidly Windows has started closing the market share gap in Spain, Italy and France. Because Nokia has had trouble ramping up the production of the new Lumia 920 and 820 Windows models, it chose to crank out older Windows models like 800 and 610 for remarkably aggressive Christmas promotions. As European markets are now hitting 50% smartphone market penetration, consumer demand is shifting towards cheap models, and Apple cannot compete in the budget category. The new first-time smartphone buyers have a lot lower household income than the consumers who bought smartphones in 2010. In the recession-ravaged Europe, the upgrade cycle is lengthening and prepaid smartphones are a more important part of the overall product mix.

As a result, Windows market share in Italy hit a stunning 11.8% in November despite the razor thin availability of the Lumia 920. Windows has already erased most of the market share lead iPhone had in Italy. The iOS market share slipped to 20.6% during the last month. In Spain, Windows market share vaulted to 3% from 0.4% a year earlier while iOS share faded to 4.4%. As the affordable HTC (2498) 8S ramps up and the even cheaper Lumia 620 launches at the end of January, Windows may overtake iPhone in Spain already in February.


The strong performance Apple had in France and the United Kingdom kept its overall European market share climbing by 2.5 percentage points in November. But in Southern Europe, Latin America and parts of Asia, iPhone is slipping badly due to the lack of a low-end version. This is what is driving the Google (GOOG) Play revenue surge globally as Android apps now narrow the huge lead Apple built in the app market before the year 2012. Apple may well have to reconsider its iPhone pricing strategy in a fundamental way. Maintaining $ 620 ASP level globally could lead to a scenario where Android has 10-to-1 volume lead outside the United States and Northern Europe, and Windows actually has a shot at pulling well ahead of Apple in lower income countries from Spain to Brazil to South-East Asia.

Predicting who’s at risk for violence isn’t easy






CHICAGO (AP) — It happened after Columbine, Virginia Tech, Aurora, Colo., and now Sandy Hook: People figure there surely were signs of impending violence. But experts say predicting who will be the next mass shooter is virtually impossible — partly because as commonplace as these calamities seem, they are relatively rare crimes.


Still, a combination of risk factors in troubled kids or adults including drug use and easy access to guns can increase the likelihood of violence, experts say.






But warning signs “only become crystal clear in the aftermath, said James Alan Fox, a Northeastern University criminology professor who has studied and written about mass killings.


“They’re yellow flags. They only become red flags once the blood is spilled,” he said.


Whether 20-year-old Adam Lanza, who used his mother’s guns to kill her and then 20 children and six adults at their Connecticut school, made any hints about his plans isn’t publicly known.


Fox said that sometimes, in the days, weeks or months preceding their crimes, mass murderers voice threats, or hints, either verbally or in writing, things like “‘don’t come to school tomorrow,’” or “‘they’re going to be sorry for mistreating me.’” Some prepare by target practicing, and plan their clothing “as well as their arsenal.” (Police said Lanza went to shooting ranges with his mother in the past but not in the last six months.)


Although words might indicate a grudge, they don’t necessarily mean violence will follow. And, of course, most who threaten never act, Fox said.


Even so, experts say threats of violence from troubled teens and young adults should be taken seriously and parents should attempt to get them a mental health evaluation and treatment if needed.


“In general, the police are unlikely to be able to do anything unless and until a crime has been committed,” said Dr. Paul Appelbaum, a Columbia University professor of psychiatry, medicine and law. “Calling the police to confront a troubled teen has often led to tragedy.”


The American Academy of Child & Adolescent Psychiatry says violent behavior should not be dismissed as “just a phase they’re going through.”


In a guidelines for families, the academy lists several risk factors for violence, including:


—Previous violent or aggressive behavior


—Being a victim of physical or sexual abuse


—Guns in the home


—Use of drugs or alcohol


—Brain damage from a head injury


Those with several of these risk factors should be evaluated by a mental health expert if they also show certain behaviors, including intense anger, frequent temper outbursts, extreme irritability or impulsiveness, the academy says. They may be more likely than others to become violent, although that doesn’t mean they’re at risk for the kind of violence that happened in Newtown, Conn.


Lanza, the Connecticut shooter, was socially withdrawn and awkward, and has been said to have had Asperger’s disorder, a mild form of autism that has no clear connection with violence.


Autism experts and advocacy groups have complained that Asperger’s is being unfairly blamed for the shootings, and say people with the disorder are much more likely to be victims of bullying and violence by others.


According to a research review published this year in Annals of General Psychiatry, most people with Asperger’s who commit violent crimes have serious, often undiagnosed mental problems. That includes bipolar disorder, depression and personality disorders. It’s not publicly known if Lanza had any of these, which in severe cases can include delusions and other psychotic symptoms.


Young adulthood is when psychotic illnesses typically emerge, and Appelbaum said there are several signs that a troubled teen or young adult might be heading in that direction: isolating themselves from friends and peers, spending long periods alone in their rooms, plummeting grades if they’re still in school and expressing disturbing thoughts or fears that others are trying to hurt them.


Appelbaum said the most agonizing calls he gets are from parents whose children are descending into severe mental illness but who deny they are sick and refuse to go for treatment.


And in the case of adults, forcing them into treatment is difficult and dependent on laws that vary by state.


All states have laws that allow some form of court-ordered treatment, typically in a hospital for people considered a danger to themselves or others. Connecticut is among a handful with no option for court-ordered treatment in a less restrictive community setting, said Kristina Ragosta, an attorney with the Treatment Advocacy Center, a national group that advocates better access to mental health treatment.


Lanza’s medical records haven’t been publicly disclosed and authorities haven’t said if it is known what type of treatment his family may have sought for him. Lanza killed himself at the school.


Jennifer Hoff of Mission Viejo, Calif. has a 19-year-old bipolar son who has had hallucinations, delusions and violent behavior for years. When he was younger and threatened to harm himself, she’d call 911 and leave the door unlocked for paramedics, who’d take him to a hospital for inpatient mental care.


Now that he’s an adult, she said he has refused medication, left home, and authorities have indicated he can’t be forced into treatment unless he harms himself — or commits a violent crime and is imprisoned. Hoff thinks prison is where he’s headed — he’s in jail, charged in an unarmed bank robbery.

Asian shares slide as U.S. budget impasse creates anxiety






TOKYO (Reuters) – Asian shares slid on Friday after a Republican proposal to deal with a U.S. fiscal crunch failed to get enough support, deepening uncertainty over the U.S. can avert the “fiscal cliff” of automatic spending cuts and tax increases set to start January 1.


“Markets disliked signs of further delay in talks, with the risk that a deal may not be reached by the end of the year deadline,” said Yuji Saito, director of foreign exchange at Credit Agricole in Tokyo. “It clearly hit risk sentiment.”






The U.S. House of Representatives will adjourn until after Christmas, Republican Representative Peter Roskam said on Thursday, after House Speaker John Boehner‘s proposed tax bill designed to avert the fiscal cliff failed to pass.


U.S. stock index futures fell sharply. S&P 500 stock futures slipped 1.7 percent, while Dow Jones stock futures and Nasdaq futures both lost 1.5 percent.


European shares will likely drop also, with financial spreadbetters predicting London’s FTSE 100 <.ftse>, Paris’s CAC-40 <.fchi> and Frankfurt’s DAX <.gdaxi> will open down as much as 0.6 percent. <.l><.eu></.eu></.l></.gdaxi></.fchi></.ftse>


The worrying U.S. political news sparked selling in Asian shares, with MSCI’s broadest index of Asia-Pacific shares outside Japan <.miapj0000pus> wiping out earlier gains to tumble 0.7 percent. The index was on track to end the week down 0.6 percent, the first weekly loss in five weeks.</.miapj0000pus>


Markets broadly had been supported by optimism that U.S. lawmakers would avoid the fiscal cliff, which threatens to derail the U.S. economy and drag down global growth with it.


Boehner’s proposal was aimed at extracting concessions from the White House, which had threatened to veto it, and advance talks closer to a deal.


The Republican-led U.S. House of Representatives, which abruptly recessed on late Thursday, may return as soon as December 27 with a yet-to-be-decided new plan, said a senior party aide.


“This is a major setback for a Fiscal Deal compromise between the two parties. I would say that chances of a deal are down to maybe 40 percent from 65 percent — despite the dysfunction in Washington D.C,” said Douglas A. Kass, founder of hedge fund Seabreeze Partners Management Inc.


Risk assets were sold off, from shares, oil to currencies such as the Australian dollar and the euro. The yen firmed slightly, though it was pinned near multi-month lows versus the dollar and the euro on expectations for more aggressive Bank of Japan easing next year to drive the economy out of deflation.


“The delay in resolving the U.S. fiscal cliff problem is raising concern as the market expected some sort of positive direction out of the talks by the end of the year,” said Fujio Ando, a senior managing director at Chibagin Asset Management.


Safe-haven government bond prices rose, with U.S. 10-year Treasury yields moving away from an 8-week high hit this week, falling about 6 basis points to 1.74 percent. Benchmark 10-year Japanese government bond yields also ticked down half a basis point to 0.765 percent.


Inflows into U.S. Treasuries underpinned the U.S. dollar, which inched up 0.1 percent against a basket of major currencies <.dxy>.</.dxy>


Jim Barnes, senior fixed income manager at National Penn Investors Trust Co. in Wyomissing, Pennsylvania, saw Treasuries continuing to gain once U.S. markets open later, but expected a correction by the end of the day.


“Treasury yields will likely fall Friday morning and will begin to reverse course in the afternoon as investors become more optimistic a deal will be reached,” Barnes said.


“So far, the market has been handling setbacks in negotiation talks very well. With still a little bit of time left on the clock, this time around will be no different.”

Along with uncertainties surrounding the future of U.S. budget talks, a firmer dollar also weighed on dollar-based commodities.


The euro fell 0.3 percent to $ 1.3206, off an 8-1/2-month high of $ 1.33085 touched on Wednesday.


U.S. crude futures dropped more than $ 1 to $ 89.10 a barrel, but oil was still on track for its biggest weekly gain since August.


Spot gold extended losses to near a four-month low touched on Thursday, and was last down 0.1 percent to $ 1,644.90 an ounce. Gold remained on course for a 12th annual growth on rock-bottom interest rates, concerns over the euro zone financial stability and diversification into bullion by central banks.


YEN GAINS SLIGHTLY


Anxieties over the U.S. budget negotiations also took their toll on Japan’s Nikkei average <.n225>, which had been supported by a weaker yen. The Nikkei gave up all of earlier gains to close down 1 percent and below the key 10,000 mark it reclaimed for the first time since early April on Wednesday. <.t></.t></.n225>


The dollar was down 0.4 percent to 84.02 yen, moving away from a 20-month high of 84.62 yen hit on Wednesday.


The euro slumped 0.7 percent to 110.91 yen also off a 16-month high of 112.59 yen reached on Wednesday.


The yen was kept under pressure after the Bank of Japan further eased monetary policy as expected on Thursday, with investors anticipating that the central bank will be persuaded to pursue more drastic measures next year.


The incoming prime minister, Shinzo Abe, has called for bolder action by the central bank to help bring Japan out of decades-long deflation.


For all the fears of a fiscal cliff debacle to come, several data series showed the United States remained on a recovery track, helping to underpin the dollar.

Kenya police: 28 people killed in clashes






NAIROBI, Kenya (AP) — A police official says 28 people have been killed in clashes between farmers and herders in south-eastern Kenya.


Anthony Kamitu, who is leading police operations to prevent the attacks, said Friday that the Pokomo tribe of farmers raided a village of the Orma herding community, called Kipao, at dawn in the Tana River Delta.






The latest deaths in a tit-for-tat cycle of killings may be related to a redrawing of political boundaries and next year’s general elections, according to the U.N.


At least 110 people were killed in clashes between the Pokomo and Orma in September and October.


Animosity between the two communities over land and water resources has existed for decades.

Michael Kors replaced by Zac Posen as “Project Runway” judge






LOS ANGELES (TheWrap.com) – Michael Kors is out at “Project Runway.”


Fashion designer Kors will not be a judge on the Lifetime reality competition when it returns for its 11th season on January 24, Lifetime said Tuesday. Instead, designer Zac Posen will join Heidi Klum, Nina Garcia and Tim Gunn as a featured judge.






Lifetime told TheWrap that Kors is vacating his judge‘s position due to scheduling conflicts.


“Due to the back-to-back film schedule for seasons 10 and seasons 11 this summer, Michael was not able to commit to all the dates required for filming season 11,” a Lifetime spokeswoman said in a statement. “Always part of the ‘Project Runway‘ family, Michael will be seen in the future on the show, and we are excited to confirm that Michael will be back as a judge for the season 11 finale.”


Kors’ departure isn’t the only change that’s coming to “Project Runway” for its upcoming season. This cycle, the competing designers will be made to work together for every challenge, where they will have to work together while ensuring that their creations stand out on the runway. It’s hoped this will lead to riveting combination of collaboration and backbiting.


Guests judges for the upcoming season include Bette Midler, Susan Sarandon, Miranda Lambert, John Legend, Emmy Rossum, Kristin Davis and others.

Nintendo’s amazing triumph in Japan may doom the company






According to Japanese gaming bible Famitsu, Nintendo 3DS sold 333,000 units in the week ending December 16. Sony’s PS Vita limped along at 13’000 units. The new Wii U did an OK 130,000 units and PS3 managed 46,000 units.  The utter hardware domination of the 3DS is reshaping the Japanese software market. Franchises that were thought to be fading have been revitalized in their portable versions. The 3DS version of the ancient “Animal Crossing” series, famed for being the game where nothing happens, hit a staggering 1.7 million units last week in Japan. “Inazuma Eleven” sold 170,000 units in its launch week, up from 140’000 units its DS version managed in 2011.

Nintendo’s portable console 3DS had a muted start in its home market in the spring of 2011. Many thought that Sony would have a fair shot at competing with Nintendo once Playstation Vita launched at the end of 2011. But once Nintendo executed an aggressive price cut for 3DS in the summer of 2011 and then launched a large-screen version of the console in mid-2012, the gadget has grown into a godzilla in Japan, demolishing both Sony Vita and aging tabletop console competition.

3DS is doing well also in America, where its lifetime sales are moving close to the 6 million unit mark this holiday season. According to NPD, the 3DS sales in the US market topped 500,000 units in November. That’s a decent number, though far from the torrid volume the portable is racking up in its home market. The US November video game software chart was dominated by massive home console juggernauts: new installments of Call of Duty, Halo and Assassin’s Creed franchises  shifted more than 13 million units in retail. At the same time, the Japanese software chart remains in a Nineties time warp,  dominated by Nintendo’s musty masterpieces: Super Mario Brothers, Pokemon, Animal Crossing, etc.


Japanese and American tastes have always been different. But what we are witnessing now is a particularly fascinating divergence. American consumers are spending more of their time and money on smartphone and tablet games, while console game spending is increasingly focusing on massive, graphically stunning blockbuster titles on Xbox360 and PS3. The casual gamers are shifting to mobile games, while hardcore gamers remain attracted to sprawling epics on home consoles. The overall video game spending in America keeps declining month after month, as casual titles and mid-list games slide. But the Triple A whales like Call of Duty series are doing better than ever.


In Japan, Nintendo has been able to battle back iPhone and Android game invasion with a nostalgic series of portable games that basically recycle the biggest hits of Eighties and early Nineties. Mario, Pokemons and other portable heroes are slowly losing their grip on US and European consumers. But in Japan, some form of national nostalgia is keeping Nintendo on track.


The problem here is that the Japanese success of the 3DS may now be convincing Nintendo that it does not have to rethink its business strategy. The smartphone and tablet game spending continues growing explosively across the world. Unlike console games, mobile game sales in China are legal. The global gaming spending is shifting towards new hardware platforms even as console mammoths like Halo still reign in America. At this critical juncture, Nintendo has managed to cocoon its home market in a web of nostalgia, turning the 3DS console and its Eighties left-over franchises into epic bestsellers yet again.


This means that there is no sense of urgency to push Nintendo into rethinking its long-term plans. The company may continue simply ignoring the smartphone and tablet challenge, designing new portable consoles and the 28th Mario game to support it. 20 years ago, Japan’s insularity doomed its chances to succeed in the mobile phone business. Ithe idiosyncratic nature of Japan may now be leading its biggest entertainment industry success astray.

The $60 Billion Federal Bailout Named Sandy






In the immediate aftermath of Hurricane Sandy, federal lawmakers from both parties were quick to heap words of compassion upon the storm victims. Now those politicians are debating how much taxpayer money to put behind their rhetoric. The Federal Emergency Management Agency’s disaster relief fund barely adds up to $ 6 billion. So the Senate and the White House are each proposing to give New York, New Jersey, and Connecticut a combined $ 60.4 billion in emergency funding for disaster aid, about $ 20 billion less than what the states have requested.


The money in the Senate’s bill, being debated this week, would pay for everything from FEMA trailers to reconstruction of U.S. Coast Guard facilities. The U.S. Department of Veterans Affairs would get $ 236 million to renovate the flood-damaged Manhattan Medical Center, and another $ 1 million to fix up three national cemeteries in New York and New Jersey. There’s $ 412 million for restoring coastal ecosystems and a pot of money to help disaster victims pay for child care. People with damaged homes or businesses would be able to apply for $ 812 million in loans for rebuilding their properties. Senator Chuck Schumer (D-N.Y.) estimates that Sandy damaged or destroyed 305,000 homes and that 270,000 small businesses were shuttered in New York alone.






In some cases, the Senate wants to be a lot more generous than the Obama administration. Senate Democrats would give $ 336 million to Amtrak. Schumer says that’s how much the perennially cash-strapped railway needs to repair damage wrought by Sandy. It’s 10 times as much as the White House is requesting. For road and bridge repairs, the amount of money the Senate wants to set aside is three times the White House’s ask.


Some conservative groups are crying pork. They say the federal government risks a repeat of what happened after Hurricane Katrina, when public funds fell into the wrong hands. President Obama’s aid request is an “act of willful fiscal negligence,” reads a post on the website of Heritage Action for America. “Much of the funding goes toward superfluous programs that have no direct relation to Hurricane Sandy.” According to the group, the majority of the emergency funds being requested aren’t going to be spent until 2014.


While there’s certainly an opportunity for waste and abuse in an aid package as big as this one, it’s worth noting that not all the taxpayer money would be spent just to put things back the way they were before disaster struck—which is actually the standard under current rules for receiving FEMA funding. Democrats want to spend billions of dollars upgrading infrastructure so it can withstand a future superstorm. The Senate proposes $ 3.5 billion, an amount disaster experts say is a fraction of what it would take to hurricane-proof a large metropolitan area. The debate over these particular funds could be the most difficult for lawmakers, and its outcome the most lasting.

State Department security chief leaves post over Benghazi






WASHINGTON (Reuters) – The U.S. State Department said on Wednesday its security chief had resigned from his post and three other officials had been relieved of their duties following a scathing official inquiry into the September 11 attack on the U.S. mission in Benghazi.


Eric Boswell has resigned effective immediately as assistant secretary of state for diplomatic security, State Department spokeswoman Victoria Nuland said in a terse statement. A second official, speaking on condition of anonymity, said Boswell had not left the department entirely and remained a career official.






Nuland said that Boswell, and the three other officials, had all been put on administrative leave “pending further action.”


An official panel that investigated the incident concluded that the Benghazi mission was completely unprepared to deal with the attack, which killed U.S. Ambassador Christopher Stevens and three other Americans.


The unclassified version of the report, which was released on Tuesday, cited “leadership and management” deficiencies, poor coordination among officials and “real confusion” in Washington and in the field over who had the authority to make decisions on policy and security concerns.


“The ARB identified the performance of four officials, three in the Bureau of the Diplomatic Security and one in the Bureau of (Near Eastern) Affairs,” Nuland said in her statement, referring to the panel known as an Accountability Review Board.


Secretary of State Hillary Clinton accepted Boswell’s decision to resign effective immediately, the spokeswoman said.


Earlier, a U.S. official who spoke on condition of anonymity said Boswell, one of his deputies, Charlene Lamb, and a third unnamed official has been asked to resign. The Associated Press first reported that three officials had resigned.


PANEL STOPS SHORT OF BLAMING CLINTON


The Benghazi incident appeared likely to tarnish Clinton’s four-year tenure as secretary of state but the report did not fault her specifically and the officials who led the review stopped short of blaming her.


“We did conclude that certain State Department bureau-level senior officials in critical positions of authority and responsibility in Washington demonstrated a lack of leadership and management ability appropriate for senior ranks,” retired Admiral Michael Mullen, one of the leaders of the inquiry, told reporters on Wednesday.


The panel’s chair, retired Ambassador Thomas Pickering, said it had determined that responsibility for security shortcomings in Benghazi belonged at levels lower than Clinton’s office.


“We fixed (responsibility) at the assistant secretary level, which is, in our view, the appropriate place to look for where the decision-making in fact takes place, where – if you like – the rubber hits the road,” Pickering said after closed-door meetings with congressional committees.


The panel’s report and the comments by its two lead authors suggested that Clinton, who accepted responsibility for the incident in a television interview about a month after the Benghazi attack, would not be held personally culpable.


Pickering and Mullen spoke to the media after briefing members of the House of Representatives Foreign Affairs Committee and Senate Foreign Relations Committee behind closed doors on classified elements of their report.


Clinton had been expected to appear at an open hearing on Benghazi on Thursday, but is recuperating after suffering a concussion, dehydration and a stomach bug last week. She will instead be represented by her two top deputies.


Clinton, who intends to step down in January, said in a letter accompanying the review that she would adopt all of its recommendations, which include stepping up security staffing and requesting more money to fortify U.S. facilities.


The National Defense Authorization Act for 2013, which is expected to go to Congress for final approval this week, includes a measure directing the Pentagon to increase the Marine Corps presence at diplomatic facilities by up to 1,000 Marines.


Some Capitol Hill Republicans who had criticized the Obama administration’s handling of the Benghazi attacks said they were impressed by the report.


“It was very thorough,” said Senator Johnny Isakson. Senator John Barrasso said: “It was very, very critical of major failures at the State Department at very high levels.” Both spoke after the closed-door briefing.


Others, however, took a harsher line and called for Clinton to testify as soon as she is able.


“The report makes clear the massive failure of the State Department at all levels, including senior leadership, to take action to protect our government employees abroad,” Representative Mike Rogers, the Republican chairman of the House Intelligence Committee, said in a statement.


Senator Bob Corker, who will be the top Republican on the Senate Foreign Relations Committee when the new Congress is seated early next year, said Clinton should testify about Benghazi before her replacement is confirmed by the Senate.


Republicans have focused much of their firepower on U.S. Ambassador to the United Nations Susan Rice, who appeared on TV talk shows after the attack and suggested it was the result of a spontaneous protest rather than a premeditated attack.


The report concluded that there was no such protest.


Rice, widely seen as President Barack Obama’s top pick to succeed Clinton, withdrew her name from consideration last week.

Danes’ rep confirms the couple welcomed a baby boy named Cyrus Michael Christopher.

It’s the first child for 33-year old Danes and 37-year-old Dancy. They were married in 2009.


There’s no word yet whether the new mom will attend the Golden Globe Awards on Jan. 13. She’s nominated for Best Performance by an Actress in a Television Series for her work on Showtime’s “Homeland.”


Up next, Dancy stars in NBC’s “Hannibal,” an adaptation of Thomas Harris’ novel “Red Dragon.”

Google to sell part of Motorola for $2.35 billion






SAN FRANCISCO (AP) — Google is selling Motorola Mobility‘s TV set-top business for $ 2.35 billion, lightening the load that the Internet search leader took on earlier this year when it completed the biggest acquisition in its history.


The cash-and-stock deal announced late Wednesday will turn over Motorola‘s set-top division to Arris Group Inc., a relatively small provider of high-speed Internet equipment that is looking to become a bigger player in the delivery of video. Investors applauded the move, driving up Arris‘ stock by nearly 17 percent.






Google‘s decision to jettison the set-top boxes comes seven months after the Mountain View, Calif., company took control of Motorola Mobility Holdings in a $ 12.4 billion purchase.


The set-top boxes were never a big allure for Google, although the company is interested in finding ways to pipe its service on to TVs so it can sell more advertising.


Google prized Motorola for its portfolio of more than 17,000 mobile patents. Those form an arsenal that it can use in a fierce battle that has broken out over intellectual property as smartphones and tablet computers have emerged as hot commodities in recent years.


Motorola also makes smartphones and tablets, a manufacturing business that Google will retain, despite lingering concerns on Wall Street about the hardware shrinking Google‘s profit margins and possibly alienating other device makers that use the company’s Android software.


Besides not being a natural fit for Google, Motorola‘s set-top box also has become a potentially expensive liability. Digital video recorder pioneer TiVo Inc. is seeking billions of dollars in damages in a lawsuit alleging that Motorola‘s boxes infringed on its patents. Those claims are scheduled to go to trial next year in federal court in Texas.


Although they declined to provide specifics, Arris Group executives told analysts in a Wednesday conference call that Google still must cover most of the bill for any damages or settlement that TiVo might win.


TiVo already has negotiated about $ 1 billion in combined settlements in other patent-infringement cases it has brought against other companies, including Dish Network Corp., AT&T Inc. and Verizon Communications.


The proposed sale of Motorola‘s set-top division calls for Google to receive $ 2.05 billion in cash and $ 300 million worth of Arris stock. If the deal wins regulatory approval, Arris Group expects to take over the division before the end of June.


Google will also pare its expenses, something likely to please investors concerned about Motorola being a drag on the company’s earnings. Arris said about 7,000 people work in Motorola‘s set-top division. Google ended September with about 53,500 employees, including 17,400 who worked on the Motorola side of its operations. More than 20,000 people worked at Motorola Mobility when Google became the owner in late May, but the payroll was slashed as part of an effort to pare the losses that have been piling up within Motorola as its once popular cellphones lost market share to Apple Inc. and Samsung Electronics.


But Motorola‘s set-top business had been making money, according to Google, though the company didn’t say how much.


In the past year ending in September, Motorola‘s set-top operations generated $ 3.4 billion in revenue. That makes it twice as big as Arris Group, whose revenue totaled $ 1.3 billion during the same period. Arris Group, which is based Suwanee, Ga., had earned $ 39 million through the nine months of last year after suffering a loss of nearly $ 13 million for all of 2011.


“This represents a great leap forward for Arris,” CEO Bob Stanzione said during Wednesday’s conference call.


Arris’ stock surged $ 2.46 to $ 17 in extended trading Wednesday while Google‘s stock dipped $ 2.61 to $ 717.50.


The other half of the old Motorola Inc., Motorola Solutions Inc., remains an independent company. Based in Schaumburg, Ill., it sells communications equipment to government and corporate customers.

After Ghana vote, investors turn to economy






JOHANNESBURG (Reuters) – A closely fought but peaceful election in Ghana this month has burnished the international image of the west African oil, gold and cocoa producer as “the Switzerland of Africa.”


But to win economic bragging rights too, Ghana’s new government will have to convince investors that it can tame a swelling fiscal deficit, stabilize a volatile currency and rebuild foreign exchange reserves that have declined this year while those of other African economies have grown.






Elected President John Dramani Mahama‘s administration will have to confront these challenges while economic growth slows – albeit to a robust 7.8 percent projected for 2013, from a blistering 14.5 percent last year.


Then there is the pressure of high expectations from ordinary Ghanaians impatient to see the benefits of oil production, which started in 2010.


Investors say they would also like more opportunities to participate in Ghana’s capital markets, but the main constraints are a bond yield curve that ends at five years and a small and illiquid stock market with just 34 listed companies.


“Ghana is one of our favorite places,” said Sven Richter, head of frontier markets at Renaissance Asset Managers. “We would have more in Ghana if there was more liquidity. We have less than one percent of our fund there and we’d quite happily have 10 percent.”


Despite a legal challenge by the opposition to Mahama’s narrow victory earlier this month, the largely incident-free election in a region known for coups and civil wars has given foreign investors comfort.


“Someone described Ghana to us as the Switzerland of Africa. I think that’s an apt description,” said Ayo Salami, chief investment officer of asset manager Duet Group’s Africa Opportunities Fund. “There seems to be a continuing commitment on the part of the government to institutional reform, to embedding democratic culture. All these are things we like.”


But the government has to show it is serious about cutting Ghana’s twin deficits – on its budget and current account – which are putting pressure on the currency, Salami said, echoing the concerns of credit rating agencies.


Continuing an election year trend, heavy public spending forced the government to revise its 2012 budget deficit target to 6.7 percent of gross domestic product (GDP), from the original 4.8 percent. Some analysts think it could end up in double digits when figures are published next year.


Fitch, which affirmed Ghana’s B+ rating in September, said the gap reflects a combination of repayment of arrears, public sector wage increases and higher energy subsidies.


OIL HOPES


Finance Minister Kwabena Duffuor said last week the country would pursue a fourth year of fiscal consolidation in 2013, expecting oil, agriculture and an infrastructure program to underpin economic growth.


Salami at Duet Group warns, however, against relying too much on oil, even if output is set to increase to 120,000 barrels per day next year, from around 90,000 bpd now.


“I know the government is hoping or waiting for oil revenues to come as the cavalry over the hill to sort this out for them,” he said. “What usually happens is that when governments get a new source of revenue they find a new way to spend it.”


Ghana’s current account deficit is likely to hit 14 percent this year, from 11 percent last year, due to infrastructure spending and demand for imports from local businesses and a growing middle class.


The deficit contributed to a near 20 percent depreciation in the local cedi currency in the first half of the year before the central bank intervened.


But its efforts to shore up the cedi have hit Ghana’s foreign exchange reserves, now at $ 5.2 billion or 2.9 months of imports, just below the traditional 3-month benchmark. Ghana also bucks a sub-Saharan African trend as Nigeria, Kenya, Mozambique and others have built up their reserves this year.


DEBT CONCERNS


While the smooth elections may have allowed investors “to cut the country a bit more slack”, the worsening fiscal picture means they will not do so for long, said Giulia Pellegrini, JP Morgan strategist for sub-Saharan Africa.


She expects the cedi to lose another 5-8 percent in the new year. “Investors will increasingly be monitoring the fiscal and current account situation,” she said.


“People are taking in the full picture rather than simply saying ‘it’s stable, it’s looking good, let’s just go for it’. They’re becoming more discerning if anything.”


The country’s rapid accumulation of debt since debt relief is also a cause for concern, Pellegrini said, with external debt currently at $ 7.8 billion, nearly double its 2008 levels.


Finance Minister Duffuor said Ghana would issue a second Eurobond next year, which should help to lower borrowing costs. Ghana’s 2017 bond is trading at a yield of 4.9 percent, much lower than the 21 percent investors demanded for a 3-year domestic bond sold in October.


Given high liquidity globally and the success of previous Eurobonds from African sovereigns, the issue should do well. But investors could make Ghana pay if it does not work on its budget. “Investors would still show quite a bit of interest but would want to be compensated for that,” Pellegrini said.

“Zero Dark Thirty” review: Like a really good “Law & Order” – with waterboarding






LOS ANGELES (TheWrap.com) – It’s always a challenge to tell a story where the audience knows the ending. The trick comes in offering a new perspective on familiar events or at least generating suspense in a way that makes us nervous that Apollo 13 might not land safely, even when history tells us otherwise.


“Argo” and “Lincoln” are two films that successfully tread these waters, and now comes “Zero Dark Thirty,” Kathryn Bigelow‘s eagerly awaited follow-up to “The Hurt Locker.”






She and screenwriter Mark Boal have consciously chosen to take a just-the-facts-ma’am approach to the manhunt and subsequent killing of Osama bin Laden, and while there’s no denying the skill with which they’ve gone about telling the tale, the results are simultaneously uninvolving and somewhat infuriating.


Uninvolving, to some extent, because the people in this movie are not so much characters as they are plot functionaries, chess pieces that move around strategically to capture their target. Jessica Chastain stars as Maya, a CIA agent who, with each passing year, grows more determined to nab the man behind the 9/11 attacks.


There’s nothing wrong with this style of storytelling — giving us some backstory about Maya’s taste in men or love of antique cars or whatever wouldn’t necessarily add anything to what Bigelow and Boal are trying to do here – but it’s a gamble that doesn’t quite pay off.


After spending its first half getting into the false leads and call-tracing and all the nitty-gritty of a manhunt, “Zero Dark Thirty” subjects its capable lead character to the requisite scene in which she snaps and barks at her bureaucrat boss (played by Kyle Chandler) that she’s so close, and not to take her off the case.


It’s a moment that feels like it might have come from any given episode of “Homeland” or any TNT show about a plucky female cop, and it capsizes a movie that, until that point, had been a fairly fascinating examination of the unglamorous sausage-making that goes into a worldwide search for a terrorist.


The somewhat infuriating facet comes early on, as we watch Maya observe seasoned interrogator Dan (Jason Clarke, giving a fascinating performance) torture terror suspects to find out what they know about September 11. The movie indirectly implies that waterboarding and electrodes to the genitals and all that other stuff that George W. Bush‘s consiglieri convinced him were kosher actually resulted in actionable intelligence, despite the reams of reportage that suggested otherwise.


I believe Bigelow and Boal’s after-the-fact denials that they intended to glorify torture in any way, but when you include material like this in a movie that takes such a coolly detached tone in telling its story, you can’t then be surprised later when some viewers interpret a filmmaker’s neutral tone as an implicit endorsement.


Still, even if the eventual raid on the bin Laden compound isn’t as exciting as the film’s first half (this is where some “Argo”-style suspense might have come in handy), there’s a lot to recommend about “Zero Dark Thirty,” which more often than not reflects Bigelow’s consummate abilities as an action filmmaker; her no-frills skills in mounting car chases, surveillance and the other tools of the CIA trade get a full workout.


The acting is also uniformly strong, although if you found the parade of famous faces popping up in “Lincoln” to be distracting, you ain’t seen nothing yet. Many recognizable performers turn up very briefly for their chance to be in the new Bigelow movie, to the occasional point of distraction. (I started counting lines from well-known actors; “Torchwood” star John Barrowman? Two.)


And even if “Zero Dark Thirty” packs something less of a punch than “The Hurt Locker,” it’s still a movie that’s going to part of the national discussion, both politically and artistically, and deservedly so. Whether you love it, hate it, or have mixed feelings, it’s not to be ignored.

Merck KGaA cancer drug Stimuvax fails late-stage trial






FRANKFURT (Reuters) – German drugmaker Merck KGaA‘s cancer vaccine Stimuvax has failed to meet its goal of improving the survival of lung cancer patients in a late-stage trial.


“It is disappointing that the… trial did not meet its primary endpoint, in particular for patients suffering from NSCLC (non-small cell lung cancer),” the trial’s coordinating investigator, Frances Shepherd, said in a statement on Wednesday.






The trial was testing Stimuvax on more than 1,500 patients with stage III non-small cell lung cancer whose tumors could not be completely removed via surgery and whose disease had at least stabilized following chemoradiotherapy.


Merck shares fell 3.5 percent to 98.00 euros in early trade, while Germany’s blue-chip DAX index was up 0.2 percent. The news that Stimuvax failed its Phase III trial is also a fresh blow to Oncothyreon Inc, the vaccine’s developer.


But Merck said it had seen “notable treatment effects” in certain subgroups of patients and would analyse further data on the drug in the coming weeks. It said it would discuss the data with experts and regulatory authorities over the coming months.


Stimuvax is one of a number so-called therapeutic cancer vaccines being developed by drug companies to fight tumors by stimulating the body’s immune system.


The first such vaccine was approved two years ago but Provenge for prostate cancer, made by Dendreon, has met with limited success, due to management missteps and doctors’ reluctance to adopt the difficult-to-administer therapy.


A number of other cancer vaccines are in development that analysts believe may be more successful, including a product from GlaxoSmithKline against melanoma and lung cancer which is set to report clinical trial results next year.


Some investors had already been wary about prospects for Stimuvax after Merck said in March the trial would be continued and final data would be presented later than expected, raising doubts over its success.


“Given the history of the drug development with postponements, discontinuations and break-ups we are not surprised about today’s outcome,” DZ Bank analyst Peter Spengler said.

Sweden cuts main interest rate to 1 percent






STOCKHOLM (AP) — Sweden‘s central bank has cut its key interest rate by a quarter of a percentage point to 1 percent as inflationary pressures remain benign and problems in Europe weigh on the Scandinavian country’s economy.


Tuesday’s decision was widely expected.






The Riksbank also says that its main interest rate will likely “remain at this low level for the coming year” due to the economic slowdown, rising unemployment and subdued inflation.


By the end of 2013, it expects inflation to start edging up as the global economic recovery gathers steam, partly on the back of recent measures taken by the 17 EU countries that use the euro to get a grip on their 3-year debt crisis.


The Riksbank says the weaker European economy has so far had “a clear effect” on Sweden.

Syrian rebels take control of Damascus Palestinian camp






BEIRUT (Reuters) – Syrian rebels took full control of the Yarmouk Palestinian refugee camp on Monday after fighting raged for days in the district on the southern edge of President Bashar al-Assad‘s Damascus powerbase, rebel and Palestinian sources said.


The battle had pitted rebels, backed by some Palestinians, against Palestinian fighters of the pro-Assad Popular Front for the Liberation of Palestine-General Command (PFLP-GC). Many PFLP-GC fighters defected to the rebel side and their leader Ahmed Jibril left the camp two days ago, rebel sources said.






“All of the camp is under the control of the (rebel) Free Syrian Army,” said a Palestinian activist in Yarmouk. He said clashes had stopped and the remaining PFLP fighters retreated to join Assad‘s forces massed on the northern edge of the camp.


The battle in Yarmouk is one of a series of conflicts on the southern fringes of Assad’s capital, as rebels try to choke the power of the 47-year-old leader after a 21-month-old uprising in which 40,000 people have been killed.


Government forces have used jets and artillery to try to dislodge the fighters but the violence has crept into the heart of the city and activists say rebels overran three army stations in a new offensive in the central province of Hama on Monday.


On the border with Lebanon, hundreds of Palestinian families fled across the frontier following the weekend violence in Yarmouk, a Reuters witness said.


Syria hosts half a million Palestinian refugees, most living in Yarmouk, descendants of those admitted after the creation of Israel in 1948, and has always cast itself as a champion of the Palestinian struggle, sponsoring several guerrilla factions.


Both Assad’s government and the mainly Sunni Muslim Syrian rebels have enlisted and armed divided Palestinian factions as the uprising has developed into a civil war.


“NEITHER SIDE CAN WIN”


Syrian Vice President Farouq al-Sharaa said in a newspaper interview published on Monday that neither Assad’s forces nor rebels seeking to overthrow him can win the war.


Sharaa, a Sunni Muslim in a power structure dominated by Assad’s Alawite minority, has rarely been seen since the revolt erupted in March 2011 and is not part of the president’s inner circle directing the fight against Sunni rebels. But he is the most prominent figure to say in public that Assad will not win.


Sharaa said the situation in Syria was deteriorating and a “historic settlement” was needed to end the conflict, involving regional powers and the U.N. Security Council and the formation of a national unity government “with broad powers”.


“With every passing day the political and military solutions are becoming more distant. We should be in a position defending the existence of Syria. We are not in a battle for an individual or a regime,” Sharaa was quoted as telling Al-Akhbar newspaper.


“The opposition cannot decisively settle the battle and what the security forces and army units are doing will not achieve a decisive settlement,” he said, adding that insurgents fighting to topple Syria’s leadership could plunge it into “anarchy and an unending spiral of violence”.


Sources close to the Syrian government say Sharaa had pushed for dialogue with the opposition and objected to the military response to an uprising that began peacefully.


In a veiled criticism of the crackdown, he said there was a difference between the state’s duty to provide security to its citizens, and “pursuing a security solution to the crisis”.


He said even Assad could not be certain where events in Syria were leading, but that anyone who met him would hear that “this is a long struggle…and he does not hide his desire to settle matters militarily to reach a final solution.”


In Hama province, rebels and the army clashed in a new campaign launched on Sunday by rebels to block off the country’s north, activists said.


The Syrian Observatory for Human Rights, an opposition-linked violence monitor, said fighting raged through the provincial towns of Karnaz, Kafar Weeta, Halfayeh and Mahardeh.


It said there were no clashes reported in Hama city, which lies on the main north-south highway connecting the capital with Aleppo, Syria’s second city.


Qassem Saadeddine, a member of the newly established rebel military command, said on Sunday fighters had been ordered to surround and attack army positions across the province. He said Assad’s forces were given 48 hours to surrender or be killed.


In 1982 Hafez al-Assad, father of the current ruler, crushed an uprising in Hama city, killing up to 30,000 civilians.


Qatiba al-Naasan, a rebel from Hama, said the offensive would bring retaliatory air strikes from the government but that the situation is “already getting miserable”.
